CHAPTER 82

Section 82-1 Changing Terms of Elective Officers


[History: Adopted by the Town Board of the Town of Kinderhook 9-26-05 as L.L. No. 2-2005.]

        
Notwithstanding the provisions of Section 24 of the Town Law of the State of New York  or any general law ,  and at least 90 days prior to any biennial Town election, the Town Board of the Town of Kinderhook may adopt a resolution to provide that the term of office of each or any elective town official thereafter elected shall be four years, and such resolution shall be submitted to the qualified electors of the Town of Kinderhook for their approval or disapproval at the next biennial Town Election.  No such resolution shall become effective until approved by  the majority of the qualified electors of the Town of Kinderhook voting on such proposition.  The submission of such proposition shall be as provided in article seven of the New York State Town Law for a referendum thereunder in like manner as if a petition therefor had been filed in accordance with the provisions of Chapter 62 of the New York State Town Law, except that such proposition shall be submitted only at a biennial Town election as hereinafter provided.  If the Town Board of the Town of Kinderhook shall have adopted such a resolution and if a majority of the votes cast on any such proposition when submitted as herein provided shall be in the affirmative, the terms of office of those Town Officers included in such proposition and elected at the biennial Town election at which the proposition was approved shall be for a period of four years.  Thereafter the term of each  elective office which was extended from two to four years as aforesaid shall continue to be four years.  (Pursuant to the provisions of Section 10 of the New York State Municipal Home Rule Law Section 24-a [1] of the New York State Town Law is hereby superceded).

        ARTICLE III - EFFECTIVE DATE

This Law shall take effect immediately upon its filing with the Office of the Secretary of State
